Purchases

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete. You expressly agree that Twitch Overlay is not responsible for any loss or damage arising from the submission of false or inaccurate information.
By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.
Returns and Refunds Policy
We do not issue refunds for digital products once the order is confirmed and the product is sent, as these digital products cannot be returned.
Professional Customisation & Custom Design Orders
Professional Customisation, and entirely bespoke or customised design orders, are provided as a service. This service, and the digital designs delivered are non-refundable.

Availability, Errors and Inaccuracies
We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other web sites. You expressly agree that any such offer of a product or service does not constitute a legal offer capable of attracting legal consequences.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice. Section “Availability, Errors and Inaccuracies” is without prejudice to existing statutory rights.
Downloadable Content
We authorise the use of our downloadable content, both Free and Premium, for personal use only. If you wish to use our content in any other context, including as advertising or promotional materials, you will require expressed written permission from TwitchOverlay.com which can be requested via our contact page.
Contests, Sweepstakes and Promotions
Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through the Service may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms and Conditions, the Promotion rules will apply. The terms and conditions of any other “Promotions” are independent of this agreement.
Affiliates and Affiliate Marketing
All standard Terms apply, but in addition the following should be noted and accepted for those joining the site as Affiliates:
- Once approved (at the discretion of TwitchOverlay.com), Affiliates can access features to generate links and campaigns, and download marketing graphics and videos provided by us.
- At the discretion of TwitchOverlay.com, some select Affiliates and will receive discount codes that grant savings on designs.
- When a visitor clicks through a link and/or uses a discount code on TwitchOverlay.com, a predefined percentage of that visitor’s purchase will be credited to the Affiliate.
- Affiliates who reach and exceed the payment threshold of $10.00 USD on verified sales will receive payments at the start of the month.
- Afformentioned payments may however be held indefinitely until sales can be verified.
- An affiliate may not use their own referral link to make purchases on TwitchOverlay.com
- Affiliates shall comply with all applicable laws pertaining to their region, state, and country. When in doubt Affiliates should designate marketing content as an “advertisement” or “ad” for full transparency.
- TwitchOverlay.com reserves the right to revoke Affiliate status at any time.
Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

The Service and its original content, features and functionality are and will remain the exclusive property of Twitch Overlay and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Twitch Overlay.
Unless expressed written permission is given, you may not alter the content provided beyond personalising text, and color-shifting (adjusting the overall color from one to another). Changing the structure and shape of any graphic provided in downloaded content is forbidden. This does not include enlarging or shrinking a graphic to fit a required purpose, which are permitted.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Twitch Overlay.
Twitch Overlay has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Twitch Overlay shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Indemnification
You agree to defend, indemnify and hold harmless Twitch Overlay and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
